Pretty in Ink Creations Policy

This Agreement is entered into by and between Pretty in Ink Creations and its subgroup Pretty in Ink Creations a sole trading business under the laws of the United States (“Designer”) and YOU (“Client”) with respect to designer services as client’s graphic design in accordance to the following:

PRETTY IN INK CREATIONS POLICY OUTLINE: 


• 50% of the invoice MUST be paid upon receipt of the invoice
• PIIC does NOT offer any refunds
• PIIC does NOT offer payment plans
• Custom Packages must be paid IN FULL before any files are sent out 
• Design process can take anywhere from 1 - 3 days 
• You get 2 free revisions, after that my hourly rate will apply of $25 an hour
• ABSOLUTELY NO MICRO MANAGING OF ANY KIND IS ALLOWED OR YOU FOREFIT THE POLICY WHICH CAN CAUSE A PAUSE/CANCELLATION IN YOUR DESIGN

CONFIDENTIALITY:

1. All client information and materials are considered confidential and only for use by Pretty in Ink Creations LCC to provide a quote or complete a project. Client information and project materials will not be given out or shared with any third party, unless otherwise requested by the client.

 

2. Pretty in Ink Creations LLC retains the right to use client’s name and book title on Pretty in Ink Creations LLC website and to market and promote our services.

 

3. Under no circumstances will any information be shared with anyone who is not a part of the Pretty in Ink Creations LLC design team.

 

OWNERSHIP RIGHTS:

4. Upon receipt of full payment, Pretty in Ink Creations LLC grants the client exclusive license to use the final cover design artwork (PDF, JPEG or other publishing-ready format) for his/her book and/or e-book cover and associated promotional materials.

 

5. The client understands that he/she has no right to alter the final cover design in any way except to change size for printing or digital display. If the client desires any alterations, he/she will consult Pretty in Ink Creations LLC. The client understands that additional payments may be required to make these alterations.

 

6. The client agrees to abide by the terms of any license agreement for any images purchased by Pretty in Ink Creations LLC through a third-party image provider for use in client’s book cover design. 

·      6 a) The cost of cover design includes the license to use these images and is limited to a print run of 250,000 units. 

·      6 b) For books with a print run over 250,000, additional licensing fees may apply. Images used for client’s cover are royalty-free; however, the photographer owns the copyright to those photographs and they cannot be distributed in any manner other than in the book cover design.

 

7. Pretty in Ink Creations LLC retains the right to use client’s final book cover design, name, and book title in Pretty in Ink Creations LLC portfolio and to market and promote our services. 

 

8. Pretty in Ink Creations LLC retains copyright and ownership of all design and draft materials.

9. Access to the PSD is not granted with payment for design work. Pretty in Ink Creations LLC does not have to send this with final files and does not have to transfer any copyright over to the author - during or after the design process.

10. If the client wishes to receive their artwork free of any typography, the client understands they must pay additional for this. This is not included in the packages.

 

11. Pretty in Ink Creations LLC owns all intellectual copyrights to the design. No replication or continuation of the design can be done by anyone else other than Pretty in Ink Creations LLC. 

 

12. If the client supplies Pretty in Ink Creations LLC with materials subject to intellectual property rights by a third-party, the client will secure the appropriate rights to use the materials before directing the designer to incorporate them into his/her project.

·      12 a)  Pretty in Ink Creations LLC reserves the right to request a copy of secured rights. Should any intellectual property dispute arise involving materials the client provides, the client assumes full legal and financial responsibility.

 

ATTRIBUTION:

13. Pretty in Ink Creations LLC requires cover design credit to appear in client’s book (either on the back cover or on the copyright page) as such: “Cover Design © Dez Purington @ Pretty in Ink Creations”

 

 

CLIENT RESPONSIBILITIES:

14. Client is fully responsible for proofing the book cover design provided by Pretty in Ink Creations LLC. It is strongly suggested that client requests a proof from the printer before publishing or ordering any copies of the book. 

 

15. At no time will Pretty in Ink Creations LLC be held financially or legally responsible for any problems, costs, fees or expenses incurred by the client as a result of using the book cover design.

 

16. The deposit is non-transferrable.

 

17. The Client is required to have the contract signed, the deposit or full payment made, and the design brief filled out before their ‘week commencing’ date. The job must be ready to start the Monday of the booking week in question.

 

18. If the Designer has to follow up for any of these within one day of the booking (the day prior) or after the ‘week commencing’ date, the job will be cancelled, and the Client will forfeit their deposit.

 

19. The Designer will strive to start ALL custom work between Monday and Wednesday of every week with final files delivered before the end of the week, Friday.

 

20. The Client acknowledges this and agree to be prepared and active.

 

21.  The Client will utilize all aspects of the design brief to make sure they supply all important information, including covers that match their prospective market, integral design details (character descriptions, relevant objects, themes within the story, plots that are key), and any other information to help make their cover as unique and their design brief as clear as possible for their book and their needs.

 

22. The Client understands they must play an active role within the process of creating their cover artwork until the point of approval. This could be with clear and concise feedback, or helping the Designer with finding stock images, if the designer has failed to find adequate matches to the details given to them by the Client.

 

23. If the Client is bringing an image they have retained exclusively from a photographer, they must have the exclusive rights to these.

·       23 a). It is the Client’s responsibility to let the Designer know of any limitations.

·       23 b) The Client must be prepared to show proof of right to use at any time.

·       23 c) The Designer is not responsible for any misuse of the exclusive image if they are not notified.

·       23 d) The Designer will not gain the rights to the image if the project is suspended. Only the artwork will remain their property.

·       23 e) Once final files are sent, the Designer cannot be held accountable for any misuse of an image that the Client has approved and received final files for. This includes any type of negative repercussions they receive as a result of using the image.

 

24. AI artwork is strictly prohibited.

·       24 a) The Client acknowledges the Designer will not accept any exclusive imagery that is evidently AI generated in any way.

·       24 b) The Designer will strive to avoid AI generated artwork at all costs while searching on any stock image supplier.

 

25. Any issues with final files must be brought to the Designer’s attention within twenty-four-hours of being sent. Any errors and editing issues can be addressed within this timeframe without additional charges.

·       25 b) Errors found outside of this twenty-four-hour period are billable the hourly rate of $25/hour.

 

26. The Client acknowledges that human error does occur.

 

27. The Client understands that they get 2 free revisions, any changes made outside of that are billable at the hourly rate of $25/hour. Revisions include: one image swap (be it model image, background image, ect) , two text/font changes, 2 minor changes such as color or any other minor change that does not alter the cover concept entirely. 

 

28. It is the Client’s responsibility to acknowledge that Pretty in Ink Creations LLC can change their terms and conditions to best suits the needs of the business without any warning to the client.

 

 

LIABILITY:

29. Pretty in Ink Creations LLC is not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or reputation, or loss of data, in any way related to our services. 

 

30. Pretty in Ink Creations LLC is not responsible for any claim, loss, or injury based on errors or any other inaccuracies appearing on our site or in our clients’ written documents, including without limitation as a result of any breach of the terms and conditions of this agreement.

 

31. The Client acknowledges that their approval of a design is final, and therefore take ownership of the work created between themselves and the Designer.

 

32. After receipt of final files, the Client is liable to any additional charges for errors found or changes required.

 

PAYMENT:

33. Client agrees to pay a non-refundable initial deposit of 50% of the total cost before work will begin on the project. The remaining balance is due upon approval of final book cover design or completion of manuscript editing. 

 

34. Any payments made through Pretty in Ink Creations LLC website are non-refundable

 

35. Pretty in Ink Creations LLC does not give refunds on any payment made on any service purchased

 

36. Pretty in Ink Creations LLC will not release finished files to the client or other parties until final payment has been received. 

·    36 a) The final payment is also final approval of the project, and this contract will be considered fulfilled. 

·    36 b) Pretty in Ink Creations LLC retains the right to discontinue, withhold, or suspend services for any account should payments not be paid for a contracted job in the order specified in this agreement.

·    36 c) The Designer remains owner of the final files (JPEG/PNG format) until final payment.

 

37.  Payment does not authorize the Client access to PSD files or unused concepts.

 

38.  Prices are subject to change at the Designer's discretion.

 

39.  The Designer does not need to notify clients of these changes to the business.

 

40. Payments are made through PayPal via an invoice for custom book covers. 

 

41.  All other payments for services such as Author branding, Formatting, or add-ons, can be done either via Pretty in Ink’s website or through invoicing which must be requested by the client, otherwise an link to pay via the site will be sent.

 

CANCELLATION POLICY:

42. The client or Pretty in Ink Creations LLC may cancel agreements at any time by providing written notice to the other party. 

 

43. If either client or Pretty in Ink Creations LLC cancels a project before work has started, neither the client nor Pretty in Ink Creations LLC is under further obligation to the other, and agreements will be considered cancelled.

 

44. If the client should stop or cancel a book cover design job once it has started, the client agrees to forfeit the initial 50% of the project total sum. This is to cover resources and time taken during the project up to the point of cancellation.

 

45. The client will have no rights to any mockups sent to the client and agrees to destroy them. 

 

46. If the client should stop or cancel an editing job once it has started, the client will pay for the work completed through the date of cancellation.

 

47. If the Client stops or cancels a design job once it has started, the Client will have no rights to a refund, and agree to relinquish the rights to all mock-ups sent and that these are destroyed.

 

48. The Client acknowledges the deposit is non-refundable and non-transferrable.

 

 

PROJECT SUSPENSION:

49. We sincerely request that you trust us to do the job you are paying Pretty in Ink Creations LLC to do. That you will take on board suggestions, and ideas, to be in your best interests. We take pride in our work and are not art-workers, therefore, any form of micro-managing, or forced art direction during the development of the project will not be tolerated. 

 

50. We reserve the right to suspend any project if a client: interferes with excessive micromanaging, demonstrates a continued lack of trust and inability to move forward after showing more than a reasonable number of unique book cover ideas/concepts, and/or shows reluctance in paying the final payment.

 

51. Fair notice will be given with fair chance to remedy the situation without resorting to project suspension or termination. 

52. Any suspension, or termination, will not result in any refunds and all designs and work thus developed remain the full ownership of Pretty in Ink Creations LLC.

 

53. Prices are non-negotiable.

 

54. Any discussion over prices and any form of negotiation to lower those set out are unacceptable and may result in the cancellation of a job and will result in the loss of a deposit and any mock-ups started.

 

55. Micro-managing, outside influence, forced direction or abusive behavior during development of a project will not be tolerated.

 

56. In the event of a project suspension, the Client cannot take the design already developed with the Designer to another designer to create.

 

57.  If the Client does use the concept created by the Designer, the Client is liable to make full payment of a package to cover the loss including a possible charge for the intellectual copyright and may face legal action.

 

 

DEFAMATION OF CHARACTER OR BUSINESS:

 

58. The Client acknowledges that by placing payment for package or service by the Designer they are agreeing to not post slanderous or hurtful comments on social media and/or third-party platforms that in any way may affect the Designer’s business.

 

59. Under The Defamation Act of 2013 any posts on social media and/or third party may be liable to legal action and may be fined under this civil law.

 

60. Any posts deemed slanderous from clients outside of the UK, will be dealt with similarly to clause 38a, and legal action will be taken if unfair libel is seen to have a negative impact on the business.

 

61. Any issues the Client may have with any aspect of the Designer must be brought to their attention so that the issue at hand can be dealt with in a timely and respectful manner.

 

62. The Designer promotes creating a positive work setting and will always strive to rectify any issues clients may have.

 

 

COMPLETE AGREEMENT:

63. This agreement is the entire agreement of all parties. No additional promises or conditions, written or oral, apply to this agreement that are not included herein.

 

64. Errors do not affect the contract.

 

65. These terms and conditions are non-negotiable.

 

66. It is the client’s responsibility to give the correct information if they write under a penname. Both names should be stated.

 

67. The Client agrees to behave under these terms set out in the contract and any future terms that may be implemented by the Designer.

 

68. It is the client’s responsibility to read the terms and conditions listed out by the Designer and Pretty in Ink Creations LLC.

69. By paying the invoice sent by Pretty in Ink Creations LLC, you are agreeing to these terms outlined. It is also stated on the form filled in that you have to agree to these terms and by selecting yes, you have therefore agreed to Pretty in Ink Creations LLC terms and conditions.
